Terms of Service

Professional Licensing

Our services are intended exclusively for licensed mental health professionals, including:

• Licensed Psychologists (PhD, PsyD)
• Licensed Clinical Social Workers (LCSW)
• Licensed Professional Counselors (LPC, LPCC)
• Licensed Marriage and Family Therapists (LMFT)
• Psychiatrists and Psychiatric Nurse Practitioners
• Clinical Psychology Graduate Students under supervision

You represent and warrant that you hold all necessary licenses and credentials to practice in your jurisdiction and to administer the assessments provided on our platform.

Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up-to-date

Age Requirement

You must be at least 18 years old to create an account and use our services.

Subscription Plans

We offer multiple subscription tiers with varying features and pricing. Current plans include:

• Basic: $29/month - Individual practitioners with limited features
• Professional: $79/month - Unlimited access with advanced features
• Enterprise: Custom pricing - Large organizations with custom needs

Billing and Renewal

• Subscriptions are billed monthly or annually in advance
• Automatic renewal unless canceled before the next billing cycle
• Price changes will be communicated 30 days in advance
• You authorize us to charge your payment method on file
• Failed payments may result in service suspension

Cancellation and Refunds

• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused services
• Access continues until the end of the paid period
• Data export available for 30 days after cancellation

Free Trials

Free trials may be offered at our discretion. If you do not cancel before the trial ends, you will be automatically charged for the subscription plan selected at sign-up.

Permitted Use

You may use our services only for lawful professional purposes in accordance with these Terms and all applicable laws and regulations.

Prohibited Activities

You agree NOT to:

• Use the platform for any unlawful purpose or in violation of professional ethics
• Share your account credentials with unauthorized individuals
• Attempt to reverse engineer, decompile, or hack our systems
• Circumvent security measures or access controls
• Upload malware, viruses, or harmful code
• Extract or scrape assessment content or algorithms
• Use automated tools to access the platform without permission
• Impersonate others or provide false information
• Violate patient privacy or HIPAA regulations
• Resell or redistribute our services without authorization

Consequences of Violation

Violation of these terms may result in immediate account suspension or termination without refund, and we may report violations to appropriate licensing boards or law enforcement.

Our Content

All content on the LetPhsyc platform, including assessment instruments, software, algorithms, text, graphics, logos, and user interface, is owned by or licensed to LetPhsyc and protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our services for your professional practice during your subscription period. This license does not include:

• Right to copy, modify, or create derivative works
• Right to distribute or sell our content
• Right to use our trademarks without permission
• Right to access source code or underlying algorithms

Your Data

You retain all rights to your patient data and clinical notes. By using our services, you grant us a license to host, store, and process your data solely for the purpose of providing services. We claim no ownership over your data.

Feedback

Any feedback, suggestions, or ideas you provide may be used by us without restriction or compensation to you.

Service "As-Is"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Medical Advice

LetPhsyc does not provide medical or mental health advice. Our platform is a tool for licensed professionals. We are not responsible for clinical decisions made using our services.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LETPHSYC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OUR SERVICES.

Our total liability for any claims related to our services is limited to the amount you paid us in the 12 months preceding the claim.

Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We are not liable for service disruptions due to maintenance, technical issues, or forces beyond our control.

Termination by You

You may terminate your account at any time by canceling your subscription through account settings. You remain liable for all charges incurred prior to termination.

Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms of Service
• Fail to pay subscription fees
• Engage in fraudulent or illegal activity
• Pose a security risk to our systems or other users

Effect of Termination

Upon termination, your right to use our services ceases immediately. We will provide 30 days to export your data, after which it may be permanently deleted (subject to legal retention requirements).

Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

Arbitration

Any dispute arising from these Terms or our services shall be resolved through binding arbitration in Los Angeles, California, in accordance with the American Arbitration Association's rules. You waive the right to participate in class action lawsuits.

Exceptions

Either party may seek injunctive relief in court for intellectual property violations or confidentiality breaches.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use constitutes acceptance of modified terms.

Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

Entire Agreement

These Terms, together with our Privacy Policy and HIPAA Compliance Statement, constitute the entire agreement between you and LetPhsyc.

Assignment

You may not assign these Terms without our written consent. We may assign our rights without restriction.

Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.
